[applause] >> [inaudible] last week, you may -- stephanie simon wrote a much discussed story. the obama administration has supported teacher evaluation. are there particular points that have been surprising or more severe? >> there is a reality. in one of your articles, he came to some of the same conclusions. it is hard. it is hard in a state like connecticut that had taken a backseat on reform for a long period of time. massachusetts had been on school reform for about -- their graduation rate went up at a time when ours went down by one 1.8%. we have turned that around already on the graduation rate. they have implemented a lot of things. when it comes to doing common core and making adjustments to some of the improvements, they have an easier life than we do. we are trying to do a lot more any much shorter period of time. it is not complicated because -- by not coming to the table, it is rather like freaking out on the garden hose. you want to hold people accountable. you want to to institute the core. that is a hard job. >>

reports. >> reporter: a fresh, new legal challenge to obama care began in federal court this week as a group of business owners and individuals from states who opted out of creating a state exchange are fighting an irs regulation which they believe is unlawful, financially damaging and exposes them to massive employer and individual obligations. david cleminsic of west virginia is one of the plaintiffs who says he will be affected. >> i'm a sole proprietor in a retail shop in a very small community, population 385, i believe it is now, and there's not a lot of customer base to grow for expansion. there's enough to maintain. i'm happy with where i am, but there's not enough to grow, and it would be an added expense that would make me have to really evaluate whether to continue to do business or not. >> reporter: the plaintiffs argue that the plain text of the law limits subsidies to consumers in states that have created their own exchange, making it illegal for them to be offered through the federal exchange. michael canon is director of health policy studies at the cato institute.
